	The number of foreclosed properties offered at <a href="http://www.foreclosureconnections.com/real-estate-auction.php" title="real estate auction">real estate auction</a> in Massachusetts is expected to decline in the coming months as foreclosure activities dipped in the state during the month of February 2011. Housing reports showed that foreclosure petitions and deed filings fell in February of this year compared with the same period of 2010.</p>
<p>
	Housing market observers are hoping that the drop in foreclosure-related activities will eventually translate into fewer <a href="http://www.foreclosureconnections.com/list/MA/Suffolk/Boston.html" title="foreclosure homes in Boston">foreclosure homes in Boston</a> and in the rest of the state. For the month of February, the Warren Group reported that 694 petitions were filed in the state, representing a decline of 67% compared with February 2010. Petitions are considered the first stage in the process of foreclosure and as such, can provide a hint of future foreclosure trends in the market.</p>
<p>
	During the second month of 2011, a total of 2,122 petitions were filed in the state. Housing analysts are encouraged by the fact that combined data for January and February of this year is still lower than the same two-month period of last year. This, some analysts have noted, might mean that the surge in <a href="http://www.foreclosureconnections.com/massachusetts.html" title="Massachusetts foreclosure homes">Massachusetts foreclosure homes</a> is starting to ebb. Petitions filed for January-February 2011 were down by 63% compared with the same two-month period of 2010.</p>
<p>
	The hope that fewer properties will enter foreclosed real estate auction sales this year was further supported by data for foreclosure deeds. The report from Warren Group showed that there were 515 deeds that changed hands during the month, representing a drop of 44% compared with February 2010 when 917 foreclosure actions were completed. For the first two months of 2011, deed filings for foreclosure were down by 50% compared with the same 2010 period.</p>
<p>
	Another good news revealed in the report was that petitions for <a href="http://www.foreclosureconnections.com/" title="foreclosures">foreclosures</a> in Massachusetts have been below the 1,000 mark for the third month in a row this February. Last year, statistics showed that petitions have gone beyond 2,000 in eight different months. For 2011, there have been 1,487 petitions filed so far and the total includes numbers for part of the month of March. In 2010, 3,996 petitions were already filed during the same period.</p>
<p>
	Housing experts are hoping that the slowdown in foreclosure activity in Massachusetts will mean that fewer properties will enter foreclosure real estate auction in the coming months. Although analysts admit that the housing downturn is far from over, they claimed that the positive figures are encouraging.</p>

The bargain-priced dwellings are taking a huge share of the house buying market away from new houses, they further said. However, several signs of an improving industry have been seen in Boston in the past few months.</p>

	Home builders have stated that the past couple of years have been tough for new home sellers in Boston as bank and FHA foreclosures, sold at heavily discounted rates, took buyers&#39; attention away from non-foreclosed and new dwellings. In the coming months, builders are optimistic that the trend will be reversed as the national economy improves and more jobs are created in the metro region. In addition, home builders stated that the spring season is always a great time for home sellers as buyers take advantage of the good weather to go house shopping.</p>

	Traditionally, spring home buying activities account for around 40% of full year housing purchases in Boston. They did admit that buying activities in the spring will be largely dictated by the region&#39;s job market condition.</p>

<p><!--RFarl-->As Berkshire County shows early signs of joining the foreclosure trend, the Massachusetts Senate in Pittsfield is preparing to debate a new bill aimed at shielding renters and borrowers from the chaos emanating from the foreclosure crisis.</p>
<p>While many Senators are still studying the draft, State Senator Benjamin Downing, who already broadly supports the new measures, agrees that its time to react the latest spike, especially where it affects reverse mortgages taken out by older Americans. </p>
<p>Reverse mortgages enable retirees to re-access the capital tied up in their homes – but what&#8217;s supposed to happen when their investments go sour and no longer provide the income to service the increased debt?</p>
<p>&#8220;People look for ways to try and get through difficult times,&#8221; Downing said. &#8220;They have to make sure they aren&#8217;t sacrificing short-term gains for long-term losses by agreeing to risky deals on their homes.&#8221;</p>
<p>The new legislation seeks to protect renters who find their homes foreclosed under them, and also tightens consumer protection for senior citizens. It will do this by encouraging modified loans, criminalizing mortgage fraud, and establishing a foreclosed / abandoned property register.</p>
<p>&#8220;(The national foreclosure rate) has to impact values and it has to impact everybody &#8211; there&#8217;s no getting away from it,&#8221; says Jay Anderson, president of the Pittsfield Cooperative Bank. &#8220;We&#8217;re not immune.&#8221; </p>
<p>Although Berkshire County, like many other parts of Massachusetts has been benefiting from solid local lending institutions with less risky lending policies, it now seems likely that national tends could be catching up with it too.</p>
<p>Brad Gordon, Executive Director, Berkshire Regional Housing Authority, is concerned about how effective the proposed foreclosure relief bill is likely to be. &#8220;It&#8217;s been really challenging because as much as on the federal side they&#8217;ve tried to come up with legislation that will provide a wide range of remedies for people who are at risk or are in foreclosure, they&#8217;ve been inadequate,&#8221; he said. &#8220;It creates some real steep challenges for keeping people in their current living situation.&#8221; </p>
<p>Moreover, he adds, what&#8217;s to stop bankers resisting the new bill like they&#8217;re doing everywhere else in the States? Politicians may have the best will in the world, but as long as the incentives are so low, there&#8217;s no business sense in lenders voluntarily complying. Besides, what&#8217;s the point in intervening in cases where borrowers are going to default anyway?</p>
<p>Are these the wise words of a prophet crying in the wilderness, or just another sign that some agencies are getting tired? It&#8217;s really time for Washington to finally get tough, wade in, and sort out those less than responsible lenders who contributed to the foreclosure wave, and still think that they should be allowed to make good money out of it too.</p>

	As the foreclosure homes inventory soared for April 2008, the state of Massachusetts is waking up to a new threat unraveled by the astounding rise in foreclosure rates. The foreclosure deeds filed in this month jumped a staggering 187.5% from 2007 and has gained the dubious reputation of being the highest number of deeds filed for any single month since the year 2005, as per the latest figures.</p>

	The 1,334 foreclosure deeds that were filed in April of the current year are extremely high in comparison to the 464 deeds filed in April last year. 	Situated at the easternmost corner of USA, Massachusetts is becoming a hot destination for foreclosed properties. All sector of the community has felt the impact of rising interest rates over the last few years. Also the rise in utility costs along with increase in gasoline prices has affected the property owner and to top it all the housing market in Massachusetts has also declined.</p>
<p>
	Massachusetts is mostly an out-of-court foreclosure state. The process of foreclosure can be done in less than three months after the lender schedules the foreclosure sale. However, before one can process the foreclosure in Massachusetts, the court must ensure that the borrower is not under the Soldiers&#39; &amp; Sailors&#39; Civil Relief Act (SCRA). This act will postpone the foreclosure action. Once, the property is cleared from all legal aspect the lender is supposed to publish a series of advertisement in the local newspaper. The notice must appear at least 21 days prior to the date of the sale. Also, a notice must be sent to the borrower or any other affected party at least 14 days before the sale.</p>
<p>
	In terms of number of Massachusetts foreclosed homes listing, Boston is in the number 1 spot with 2117 filings, followed by Springfield at 1270. Tewksbury and Somerville are at the lower rung with 99 and 97 listings respectively. But the most affected county has been Barnstable County with 96% increase at 1,141 listings, followed by Suffolk County which had a 90% increase at 2,533.</p>

	The industry predicts the foreclosures in Massachusetts will have a negative impact for the state for the year 2007. Also, there have been foreclosure auctions.
